1. Scope

These Terms and Conditions rule the provision of services ("Services") provided by Luís & João Travel ("Luís & João Travel") to a client ("Client"), unless special terms have been agreed in writing by Luís & João Travel and the Client (each a "Party" and together "Parties").

 

2. Conditions of Use

By accessing the Luís & João Travel site and using its services, the Client agrees to comply with these terms, all applicable laws and regulations, and agrees that it is responsible for compliance with all applicable laws. If you do not agree with any of these terms, you should not access this site or use our services. The materials contained in this site are protected by applicable copyright and trademark laws.

         

3. Use of Site Content

Permission is granted to temporarily download one copy of the materials (information) on Luís & João Travel's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license, you may not: modify or copy the materials; use the materials for any commercial purpose or public display (commercial or non-commercial); remove any copyright or other proprietary rights from the materials; or transfer the materials to another person or reproduce the materials on any other server.                      

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Luis & Joao Travel at any time.

 

The materials on Luís & João Travel's website are provided 'as it is'. Luís & João Travel makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.     

 

Luís & João Travel does not warrant that any of the materials on its website are accurate, complete or current. Luís & João Travel may make changes to the contents contained on its website at any time without notice. However, Luís & João Travel makes no commitment to update the content.    

 

4. Links

Luís & João Travel has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Luís & João Travel of the site. Use of any linked site is at the Client's own risk.                      

 

5. Security

​

The Client shall comply with all safety regulations applicable to the provision of services. Luís & João Travel will not be obliged to start or perform the service unless the Client complies with all applicable security requirements. If Luís & João Travel suffers damage as a result of this breach by the Client, it shall be entitled to be compensated to the extent of the damage.

When using the Service, the Client must not:

- interfere in any other way with the security of the Service;

- allow any other person to use the Service on your behalf unless authorized by Client;

- promote or engage in illegal or criminal conduct or conduct that causes damage or injury to any person or property; or

- threaten, abuse or invade privacy, or cause annoyance, inconvenience or needless anxiety or harass, annoy, embarrass, alarm or annoy any person.

Failure to comply with these rules is a serious breach of these Terms and may result in one or all of the following actions (with or without notice):

- immediate, temporary or permanent withdrawal of the passenger's right to use the Service;

- issuance of a notice to the passenger;

- legal action against the passenger, including proceedings for reimbursement of all costs (including, but not limited to, reasonable legal and administrative costs) arising from the breach;

- disclosure of such information to the authorities.

 

6. Limitation of Liability

    

In no event shall Luís & João Travel be liable for any damages (including, without limitation, loss of profit and indirect damages) arising out of the provision of services by Luís & João Travel even if Luís & João Travel or an authorized representative of Luís & João Travel has been notified orally or in writing of the possibility of such damages or had reason to know.

The maximum liability of Luís & João Travel shall not exceed the total value of the service received by Luís & João Travel.

The Client agrees that any goods or animals transported by him/her are his/her sole responsibility and that he/she must ensure that all necessary safety measures are met to perform the Service. Luís & João Travel is not responsible for any damage on goods or animals transported by the Client that does not comply with the safety rules legally applicable to the service and/or that do not comply with these Terms and Conditions.

The Client agrees that the exclusions and limitations in this article shall prevail over any conflicting clause in these Terms and Conditions and shall be given full force and effect.

 

7. Indemnification

The Parties undertake to indemnify and keep fully and effectively indemnified on demand and against any costs, losses, damages, expenses, actions, proceedings, claims, demands, rulings, fines, orders, liabilities and charges (including costs and legal and other professional fees) (together "Costs") arising out of or in connection with any claims of any kind.

The Client is fully liable for any damage or loss suffered by Luís & João Travel caused by the Client's fault or gross negligence, including indirect damage and loss of profit, and shall indemnify Luis & João Travel.

 

8. Payment Methods

Services may be paid by credit card (MasterCard, Visa and American Express), by PayPal or by bank transfer. Luís & João Travel reserves the right to accept certain methods of payment in specific cases.

 

9. Payment by bank transfer

​

If the Client wishes to make payment by bank transfer please send an email to geral@luistravel.pt, sending proof of payment and indicating the name(s) of the account holder(s) from which the transfer was made. Please note that the amount transferred may take between 2-3 working days to enter our system.

11. Invoicing

​

If the Client wishes to dispute all or any part of an invoice, the Client must, within five (5) days of receipt of the invoice, provide Luís & João Travel with written notice of the amount disputed. If the Client disputes a part of the invoice, the undisputed part must be paid immediately.

If the dispute is resolved in favor of Luís & João Travel, the Client must pay the invoice or the remainder of the invoice plus any interest accrued on the late payment.

 

12. Data Protection

Each party will comply with its obligations under all applicable data protection laws about the services to be provided. Each party agrees, in respect of any personal data provided to it by the other party, that it will act only on instructions from the other party regarding the processing of such personal data and will ensure that appropriate technical and organizational measures are taken against unauthorised or unlawful processing of personal data and against accidental loss or destruction of personal data.

Both parties shall comply with any reasonable request made by the other party to ensure compliance with the measures contained in this clause. The Client is aware and acknowledges that personal data may be processed and retained where necessary for the performance of obligations and the exercise of specific rights by the Data Protection Policy & Privacy Policy of Luis & João Travel.

 

13. Duration

The articles entitled "Limitation of Liability", "Indemnification" and "Data Protection" survive any termination, validity or cancellation of the Contract or services.

 

14. Validity

​

Any provision of these terms and conditions which is invalid or unenforceable shall not affect the validity or enforceability of any other provision of these terms and conditions. If any provision is held to be invalid or unenforceable, the parties will mutually meet with a new provision about the same subject matter.

 

15. Modifications

​

Luís & João Travel may revise these terms at any time without notice. By using this site and/or the Service, the Client agrees to be bound by the current version of these terms. 

 

16. Governing Law

​

These terms and conditions shall be governed by and construed by the laws of Luís & João Travel and the Client irrevocably submits to the exclusive jurisdiction of the courts of Portugal.
